These Terms & Conditions ("Terms") govern your engagement of nime ("nime", "we", "us", "I") for videography, content, and editing services, and your use of nime.com.au. nime is operated by Ibraheem Odzic (ABN 89 482 135 164), a sole trader based in Brisbane, Queensland, Australia.
By booking a shoot, subscribing to a package, requesting a quote, or otherwise engaging our services, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you have authority to do so. Please also read our Privacy Policy, which forms part of these Terms.
1. Our services
nime provides videography, short-form content, and editing services. These are offered as:
- Monthly packages — a recurring subscription that includes a shoot and a set runtime allowance of edited content each month.
- One-off shoot blocks — a single capture session booked by the hour or day (capture only, unless editing is added).
- Custom quotes — bespoke work scoped and priced for your specific project.
- Add-ons: optional extras, such as extra edited content cut from a shoot block's footage, selected at checkout or agreed in writing.
The specific deliverables for your engagement are those described on the relevant package or quote at the time of purchase, as may be confirmed between us in writing (including by email).
2. Bookings and scheduling
- Shoots are scheduled by agreement. We will confirm the date, time, location, and scope before each session.
- You are responsible for arranging safe and lawful access to the shoot location, and any permissions, permits, or releases required to film there.
- Shoot times are approximate and refer to the booked capture window. Significant changes to scope on the day may affect what can be captured.
- We will use reasonable efforts to meet agreed dates but may need to reschedule due to illness, equipment failure, weather, or other circumstances beyond our control (see Section 12).
3. Subscriptions and billing
- Monthly packages are billed in advance on a recurring basis from your start date, via our payment provider (see Section 5).
- Each billing cycle includes the shoot and runtime allowance described in your package. Unused allowance does not roll over to the next cycle unless we agree otherwise in writing.
- Pause or cancel anytime: you may pause or cancel your subscription effective from the end of your current paid cycle, by giving us notice before that cycle renews. We do not provide refunds for the current cycle once it has started or work has commenced.
- We may adjust package pricing or inclusions from time to time. Any change will apply from your next renewal, and we will give you reasonable notice.
4. Deliverables, runtime and revisions
- Package runtime is an upper limit of finished, edited content per cycle, which you may split into reels up to the cap stated for your package. The exact split is agreed as part of planning.
- Each package includes a stated number of major revisions per deliverable. A "major revision" is a substantive change to an edit. Minor tweaks may be accommodated at our discretion. Revisions beyond the included number, or new creative directions, may incur an additional fee.
- Revision requests should be consolidated and provided within 14 days of delivery. After that, an edit is treated as accepted.
- Creative and editorial decisions (pacing, music, framing, grade) are made using our professional judgement, guided by the brief agreed at planning.
5. Payments, GST and deposits
- Prices shown on the site are in Australian dollars and are exclusive of GST unless stated; GST is added where applicable.
- Payments are processed by our third-party provider, Stripe. By paying, you agree to Stripe's terms. nime does not store your full card details.
- One-off bookings and custom projects may require a deposit to secure the booking. Deposits are non-refundable once a date is reserved, except where required by law.
- Invoices and subscription charges are due as stated. We may pause work or delivery on overdue accounts.
6. Cancellations, rescheduling and no-shows
- If you need to reschedule a shoot, please give us as much notice as possible. We will do our best to find a new time within the same billing cycle.
- Cancellations or reschedules made with less than 48 hours' notice, and no-shows, may be treated as a used session and may not be refunded or recovered, as time and resources will have been reserved.
- If we need to reschedule due to circumstances on our side, we will offer the next available time and will not charge you twice for the same session.
7. Client responsibilities
- Provide accurate brief information, brand assets, and timely feedback so we can deliver to schedule.
- Ensure you own or have permission to use any logos, music, products, locations, or other materials you ask us to feature.
- Obtain consent from any identifiable people you arrange to appear in the content (including staff and minors, via a parent or guardian).
- Use the delivered content lawfully and in line with these Terms.
8. Intellectual property and usage rights
- On full payment for the relevant deliverable, you receive a licence to use the finished content for your own marketing and business purposes across your channels.
- Unless agreed otherwise in writing, nime retains ownership of the underlying copyright in the footage and edits, and the right to be credited as the creator.
- Portfolio use: we may use excerpts or stills from completed work in our showreel, website, and social media (@filmedbynime). If you would prefer your project not to be used this way, let us know in writing and we will respect that.
- You must not resell, sublicense, or pass off the content as your own creative work, or remove our credit where one is agreed.
9. Raw footage and files
Where a package or quote includes raw footage, it is delivered to your gallery alongside the edits and is yours to keep and reuse. We store project files securely for a limited period after delivery and may archive or delete them thereafter unless an ongoing arrangement is in place. We are not a long-term backup service; please keep your own copy of delivered files.
10. Confidentiality
We treat your brief, brand information, and unreleased footage as confidential and will not share them other than as needed to deliver the work or as required by law.
11. Liability
- We provide our services with reasonable care and skill. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
- To the extent permitted by law, our total liability for any claim connected with an engagement is limited to the fees you paid for that engagement.
- We are not liable for indirect or consequential loss (such as lost profits, lost opportunities, or third-party platform performance), or for results from how content performs once published.
12. Things outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including illness, weather, equipment or software failure, loss of access to a location, or acts of third parties. Where this happens, we will work with you to reschedule or adjust the deliverables fairly.
13. Termination
Either of us may end an ongoing engagement by giving reasonable notice as set out in Section 3. We may suspend or end an engagement if payments are overdue, or if the work would require us to act unlawfully or against these Terms. Sections that by their nature should survive (such as intellectual property, confidentiality, and liability) continue after an engagement ends.
14. Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
15. Changes to these terms
We may update these Terms from time to time. The latest version will always be on this page with the "Last updated" date above. The Terms that apply to your engagement are those in effect when you book or renew.
